Agreement and acceptance
These Terms and Conditions (“Terms”) govern your access to and use of Penacle Finspere and https://penaclefinspere.org (the “Platform”). By accessing or using the Platform, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Platform.
Who may use the Platform (18+ requirement)
You must be at least 18 years old to use the Platform. By creating an account or using Platform features, you represent that you are 18+ and capable of entering into a binding agreement under applicable laws.
What the Platform provides (scope of service)
Penacle Finspere is an online financial platform that may provide market tools, analytics, educational or informational features, user dashboards, and account access that can connect you to third-party services (including execution or trading partners) where applicable.
We do not promise that any feature will be available at all times, in all locations, or for all users.
No investment advice and no guaranteed outcomes
Information on the Platform is provided for general informational purposes and may not be suitable for your personal circumstances. It is not financial, investment, legal, or tax advice. You are responsible for evaluating any decision you make, including whether a product is appropriate for you.
Trading and investing in cryptoassets, Forex, CFDs, and equities can involve rapid losses, including the loss of your entire amount committed, depending on the product and market conditions. Past performance does not predict future results.
Account registration and user responsibilities
Accurate information
You agree to provide information that is accurate and kept up to date. If we cannot verify your details or suspect inaccurate information, we may restrict access until the matter is resolved.
Credentials and security
You are responsible for all activity under your account. You must:
- keep login credentials confidential,
- use strong passwords,
- take reasonable steps to secure devices and email accounts, and
- notify us promptly if you suspect unauthorized access.
Communications
We may send operational messages about your account, security, and the Platform. You are responsible for maintaining an active email address and checking messages in a timely manner.
Third-party services and partner platforms
Some features may involve third-party providers (for example, identity verification vendors, analytics providers, payment services, or execution partners). Those third parties may have their own terms, policies, and eligibility rules.
Where the Platform connects you to third-party services, your interactions with those third parties may be governed by their agreements. We are not responsible for third-party acts or omissions, outages, pricing, execution quality, or third-party policy changes.
Fees, charges, and taxes
We may charge fees for certain features or services, or third parties may apply their own fees (including spreads, commissions, funding fees, network fees, or withdrawal fees where applicable). Any applicable fees should be reviewed before you proceed with an action.

- use the Platform for unlawful activities or to violate any applicable restrictions,
- interfere with Platform security or attempt to access systems without authorization,
- scrape, reverse engineer, or misuse the Platform in a way that harms us or other users,
- upload malware or content designed to disrupt services,
- impersonate another person or misrepresent your affiliation.
Content, intellectual property, and limited license
The Platform, including software, text, graphics, interfaces, and trademarks, is owned by or licensed to us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Platform for personal and lawful purposes in accordance with these Terms. No rights are granted by implication.
Suspension, restrictions, and termination
We may suspend, restrict, or terminate access to the Platform (in whole or in part) if we reasonably believe:
- your account is compromised,
- your use poses security, legal, or compliance risks,
- you breached these Terms, or
- we must do so to comply with law or a competent authority’s request.
You may stop using the Platform at any time. Certain obligations (for example, dispute terms, limitations, and any accrued payment obligations) survive termination.
Service availability and changes
The Platform may change over time. We may add, modify, or discontinue features, and we may perform maintenance that causes downtime. We do not guarantee uninterrupted availability or that specific tools will remain available.
Disclaimers
To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis. We do not make warranties that:
- the Platform will be error-free, uninterrupted, or fully secure,
- information will always be complete or current, or
- any market-related content will be accurate or suitable for your needs.
Limitation of liability
To the extent permitted by applicable law, Penacle Finspere will not be liable for indirect, incidental, special, consequential, or punitive losses, or for loss of profits, loss of opportunity, loss of data, or business interruption arising from your use of (or inability to use) the Platform.
Where liability cannot be excluded, it will be limited to a reasonable amount as permitted under Singapore law and the circumstances of the claim.
Indemnity
You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Platform, or violation of any law or third-party rights.
Complaints and dispute handling approach
If you have an issue, contact support first with details of the problem, your account email, relevant dates, and any evidence (screenshots, transaction references where applicable). We aim to review and respond within a reasonable timeframe depending on complexity.
Escalation
If a matter is not resolved through support, you may request escalation for internal review. We may ask for additional information to investigate.
Governing law and jurisdiction
These Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles. Where permitted, you agree that disputes will be subject to the exclusive jurisdiction of the courts of Singapore.
Changes to these Terms
We may update these Terms to reflect operational changes, security needs, or legal requirements. Updated Terms will be posted on the Platform. If changes are material, we may also provide additional notice via email or an in-platform message. Your continued use after an update means you accept the revised Terms.
